Welcome to finding.wine. These Terms of Service govern your access to and use of the finding.wine website, including any purchases made through the site, as well as any communications, services, content, functionality, and transactions offered by finding.wine.

By accessing or using this website, creating an account, or placing an order, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you should not use this website.

2. Eligibility and Legal Drinking Age

You must be at least 21 years of age to use this website to purchase alcoholic beverages.

By placing an order with finding.wine, you represent and warrant that:

  • you are at least 21 years old;
  • the person receiving the shipment is at least 21 years old; and
  • your purchase complies with all applicable federal, state, and local laws and regulations.

finding.wine reserves the right to use reasonable means to verify age and identity and may refuse service, cancel orders, or refuse delivery if age verification cannot be completed or if we believe a purchase may violate applicable law.

All wine shipments require an adult signature at delivery.

3. Use of the Website

You agree to use the website only for lawful purposes and in accordance with these Terms of Service.

You may not:

  • use the website in violation of any law or regulation;
  • attempt to interfere with the site’s security, operation, or availability;
  • use false information when creating an account or placing an order;
  • impersonate another person or entity;
  • misuse the site, its content, or its services for fraudulent or unlawful purposes.

We reserve the right to suspend or terminate access to the website at any time for any lawful reason.

4. Product Information and Availability

finding.wine makes reasonable efforts to accurately display and describe products, vintages, bottle sizes, producer information, tasting notes, and prices. However, errors, inaccuracies, omissions, or outdated information may occasionally occur.

All products are subject to availability. Due to the real-time nature of inventory and sourcing, a product is not guaranteed to be available until it has been pulled, confirmed, and prepared for shipment.

We reserve the right to:

  • correct errors or omissions;
  • change prices at any time without notice;
  • limit quantities;
  • refuse or cancel orders;
  • substitute vintages where appropriate and with notice, where permitted;
  • discontinue products at any time.

If an item is unavailable after an order is placed, finding.wine may contact you to offer a substitution, partial fulfillment, store credit, refund, or other arrangement at our discretion.

5. Orders and Acceptance

Your submission of an order does not guarantee acceptance. finding.wine reserves the right to accept, reject, limit, or cancel any order for any lawful reason, including but not limited to:

  • product unavailability;
  • pricing or listing errors;
  • suspected fraud;
  • inability to verify age or identity;
  • shipping restrictions;
  • payment issues;
  • compliance concerns.

An order is considered accepted only after it has been reviewed and processed by finding.wine.

6. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated. Prices and availability are subject to change without notice.

By submitting payment information, you represent and warrant that:

  • you are authorized to use the payment method provided; and
  • the billing information submitted is accurate and complete.

finding.wine may use third-party payment processors to complete transactions. We reserve the right to refuse or cancel any transaction if payment cannot be verified or processed.

Applicable taxes, shipping charges, insurance, adult-signature fees, and other charges may be added at checkout.

7. Shipping and Delivery

finding.wine ships wine only where legally permitted. By placing an order, you represent and warrant that the order may lawfully be shipped to the destination address.

Wine cannot be shipped to:

  • P.O. Boxes; or
  • APO/FPO addresses.

A valid street address where an adult age 21 or older is available to sign for delivery is required. We strongly recommend shipping to a business address whenever possible.

Shipping times are estimates only and are not guaranteed. Most orders typically leave our store within 1 to 2 business days, but delays may occur due to inventory, weather, carrier issues, holidays, compliance checks, or other circumstances beyond our control.

Shipping times do not include Saturdays, Sundays, or holidays unless expressly stated otherwise.

All shipping costs are the responsibility of the purchaser unless expressly stated otherwise.

If a shipment is returned because the customer or recipient was unavailable to accept delivery, the customer will be responsible for the return shipping charges and the cost of a new shipping label before the order can be reshipped.

8. Weather and Temperature Risk

Wine is a perishable product and may be damaged by heat, cold, or sudden temperature fluctuations during transit.

finding.wine recommends against ground shipping during periods of extreme heat or freezing temperatures. In such conditions, expedited shipping or delayed shipment may be more appropriate.

If a customer elects to ship during weather-risk periods, declines a recommended weather hold, or requests a shipping method that increases temperature risk, the customer assumes that risk. To the fullest extent permitted by law, finding.wine shall not be responsible for damage, leakage, seepage, cork movement, spoilage, or other deterioration caused by temperature exposure or transit conditions beyond our reasonable control.

9. Delivery Attempts and Failed Delivery

It is the customer’s responsibility to ensure that an adult age 21 or older is available to receive and sign for the shipment.

If delivery cannot be completed because:

  • no eligible adult is available;
  • the shipping address is incorrect or incomplete;
  • delivery is refused for reasons not caused by finding.wine; or
  • the carrier is unable to complete delivery,

the package may be returned to finding.wine or held by the carrier.

In such cases, the customer may be responsible for:

  • original shipping charges;
  • return shipping charges;
  • storage fees, if applicable;
  • reshipment fees; and
  • any approved cancellation or restocking fees under our Returns & Refund Policy.

10. Returns, Refunds, and Cancellations

All returns, refunds, credits, and cancellations are subject to the finding.wine Returns & Refund Policy in effect at the time of purchase.

Unless otherwise required by law or approved by finding.wine in writing:

  • all sales are generally final;
  • returns require prior authorization;
  • approved customer-initiated returns not caused by our error may be subject to a 20% restocking fee plus applicable shipping and handling charges;
  • certain items, including pre-arrival items, special-order items, allocated wines, rare wines, and final-sale products, may not be canceled or returned.

If a conflict exists between these Terms of Service and the Returns & Refund Policy, the Returns & Refund Policy will govern with respect to returns, refunds, and cancellations.

11. Corked, Defective, or Damaged Bottles

Claims involving allegedly corked, spoiled, oxidized, or otherwise defective wines are reviewed on a case-by-case basis.

For current-release wines, finding.wine may require return of the bottle with a substantial portion of the contents remaining so the issue can be evaluated. We may also require photographs, lot information, and other supporting information.

Older vintages, library wines, and collectible bottles are sold with the understanding that bottle variation and age-related risk are inherent. Such wines are generally purchased at the buyer’s risk.

No refund, replacement, or store credit will be issued unless and until the claim is reviewed and approved by finding.wine.

12. Pre-Arrival and Futures Items

finding.wine may offer certain items on a pre-arrival, allocation, or futures basis.

Estimated arrival dates are only estimates and are not guaranteed. Delays may occur due to importer schedules, supplier delays, transportation issues, customs, allocation changes, or other circumstances beyond our control.

Pre-arrival and futures items may be subject to special cancellation restrictions. Unless otherwise stated, such items are governed by our cancellation and return policies in effect at the time of purchase.

13. Account Responsibility

If you create an account on finding.wine, you are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.

You agree to notify us promptly of any unauthorized access to or use of your account.

finding.wine is not responsible for losses arising from your failure to safeguard account credentials.

14. Intellectual Property

All content on the finding.wine website, including but not limited to text, images, graphics, logos, product descriptions, layout, branding, design elements, and software, is owned by or licensed to finding.wine and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, display, publish, transmit, create derivative works from, or otherwise exploit any website content without prior written permission from finding.wine, except as permitted by law.

15. Third-Party Services and Links

The website may contain links to third-party websites, platforms, tools, or services. finding.wine is not responsible for the availability, content, accuracy, privacy practices, or terms of any third-party website or service.

Your use of third-party services is at your own risk and subject to the terms and policies of those third parties.

16. Disclaimer of Warranties

To the fullest extent permitted by law, the website, its content, and all products and services offered through finding.wine are provided on an “as is” and “as available” basis.

finding.wine makes no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, or that the website will be uninterrupted, error-free, secure, or free from harmful components.

We do not guarantee that product descriptions, prices, inventory data, or shipping estimates will always be complete, accurate, or current.

17. Limitation of Liability

To the fullest extent permitted by law, finding.wine and its owners, affiliates, officers, employees, agents, suppliers, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to:

  • your use of or inability to use the website;
  • any order, shipment, delay, non-delivery, or failed delivery;
  • weather-related product damage;
  • product unavailability;
  • pricing errors;
  • bottle variation, age-related issues, or defective wine claims;
  • unauthorized access to your account; or
  • any other matter relating to the website or products.

In no event shall the total liability of finding.wine exceed the amount actually paid by you for the specific product giving rise to the claim.

18. Indemnification

You agree to defend, indemnify, and hold harmless finding.wine and its affiliates, owners, officers, employees, agents, suppliers, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

  • your misuse of the website;
  • your violation of any law or regulation;
  • your purchase, shipment, or receipt of wine in violation of applicable laws;
  • your negligence, fraud, or willful misconduct.

19. Privacy

Your use of the website is also subject to the finding.wine Privacy Policy. By using the website, you acknowledge that you have reviewed our Privacy Policy.

20. Governing Law

These Terms of Service and any dispute arising out of or relating to the website, any order, or any transaction with finding.wine shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.

21. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms of Service, the website, or any purchase from finding.wine shall first be addressed through good-faith efforts to resolve the matter informally.

If a dispute cannot be resolved informally, finding.wine reserves the right to require that the dispute be brought in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction and venue of those courts, unless applicable law requires otherwise.

22. Severability

If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.

23. No Waiver

The failure of finding.wine to enforce any right or provision of these Terms of Service shall not constitute a waiver of that right or provision.

24. Changes to These Terms

finding.wine may update or modify these Terms of Service at any time in its sole discretion. Any changes will be effective upon posting to the website unless otherwise stated.

Your continued use of the website after any revised Terms are posted constitutes your acceptance of the updated Terms.
